Terms and Conditions of Service
1.Acceptance of Terms
1.1 By completing a registration with this website you are seeking access to the online game world of Roma Victor ™ including the use of software provided by RedBedlam in order that you may participate in the environments that support Roma Victor (together, the "Service").
Your participation in the Service means that you agree to be bound by this Terms of Service Agreement with RedBedlam Ltd. ("the company" and/or "RedBedlam") together with the posted Community Standards on the Roma Victor website which you can find at this link:

Further, you agree that RedBedlam may, at any time, update, revise or change this agreement by posting a notice of such changes on the Website. Any changes shall become part of the Terms of Service Agreement and shall apply as soon as such a notice is posted. Your continued participation after changes are made means that you agree to be bound by all such changes. If you do not want to accept all or any part of this Terms of Service Agreement (as changed from time to time), your only suitable course of action or remittance open to you is to not open an account or cancel your account and cease using the Service.

2.Accounts
2.1 Roma Victor is an online virtual game world designed and built by RedBedlam. Upon completing the registration process, we will set up an account that is uniquely associated with your participation ("Account"). All of your access to the Service will be through that Account. By using the Service you will be able to interact with other participants and objects within the Service. Your use of the Service will be through an online avatar or virtual persona/alter-ego, and this is regulated by the Community Standards page found at http://www.roma-victor.com/community-standards
2.2 Eligibility: Accounts are permitted only for adult individuals who are 18 years of age or older. We reserve the right to request proof of age at any time to verify that minors are not using the service. Failure to produce such proof of identification and age may lead to your account being suspended indefinitely or terminated.
2.3 Registration Obligations: You agree to provide true, accurate, current and complete information about yourself as prompted by the Account Page on the Service website.
2.4 Username: You must choose an Account name to identify yourself to RedBedlam staff. Known as a Username, this Account will be linked to a character name, chosen by you. You may not select as your Username or character name the name of another person, a name which violates any trade mark right, copyright, or other proprietary right, a name which may mislead other player/participants to believe you to be an employee of RedBedlam, or a name which RedBedlam deems in its absolute discretion to be offensive or inappropriate. RedBedlam reserves the right to delete or change any Username or character name for any reason or no reason. You are fully responsible for all activities conducted through the Account or under your Username.
2.5 Passwords: At the time your Account is opened, you must accept a randomly generated password. This can be changed thereafter. You are responsible for maintaining the confidentiality of your password and are responsible for any harm resulting from your disclosure, or authorising the disclosure of, your password or from use by any person of your password to gain access to your Account or Username. At no time should you respond to an online request for a password. RedBedlam will never ask for your password offline or online, except that you will be required to enter your password as part of the log-in process. Please do not ever disclose your password to another person.
2.6 Accounts: By using the service you agree that you do not own the Account you use to access the service, nor do you own any data RedBedlam stores on RedBedlam’s servers (including without limitation any data representing or embodying any works you may have created that may be stored therein).
2.7 As a player/participant you are responsible for all activity on your Account. Violations or warnings accrued by an Account can lead to termination of that Account. Due to the fact that you are responsible for all use of your Account, you must supervise its use by others. Your Account may be terminated if you let someone use it inappropriately and/or violate any part of this agreement and/or rules governing behaviour as outlined in the Community Standards section of the website.
2.8 Termination of Account. RedBedlam and you both have the right to terminate or cancel your Account or a particular subscription at any time. You understand and agree that the cancellation of your Account or a particular subscription is your sole right and remedy with respect to any dispute with RedBedlam. This includes, but is not limited to, any dispute related to, or arising out of: (1) any term of this Terms of Service Agreement or RedBedlam’s enforcement or application of this Terms of Service Agreement; (2) the content available through the Service; (3) your ability to access and/or use the Service; or (4) the amount or type of fees, surcharges, applicable taxes, billing methods, or any change to the fees, applicable taxes, surcharges or billing methods.
2.9 You can cancel your Account or a particular subscription by delivering notice to RedBedlam at cancellations@redbedlam.com. RedBedlam reserves the right to collect fees, surcharges or costs incurred before you cancel your Account or a particular subscription. In addition, you are responsible for any charges incurred to third-party vendors or content providers before your cancellation. In the event that your Account or a particular subscription is terminated or cancelled, no refund will be granted; no online time or other credits (e.g., points in an online game) will be credited to you or converted to cash or other form of reimbursement, and you will have no further access to your Account or anything within the Service associated with it (such as points, tokens or in-game items). Active Account holders may not allow former Account holders whose Account has been terminated by RedBedlam to use their Accounts. Any delinquent or unpaid Accounts or Accounts with unresolved issues with RedBedlam must be settled before RedBedlam may allow you to register again. If your Account is terminated for any reason, RedBedlam is under no obligation to offer on-line services or any other services to you at any time in the future.
3.Privacy Policy
3.1 Security: The personal information you provide to RedBedlam during registration is used for RedBedlam’s internal purposes only. RedBedlam may transfer your personal information to a third party (including to a party outside the UK) where RedBedlam reasonably believes that it is necessary to do so for the purposes of this Terms of Service Agreement, the reorganisation of RedBedlam and/or the Service as a result of the merger or acquisition of RedBedlam or the Service. Except as otherwise expressly permitted by this Terms of Service Agreement or as otherwise authorised by you, RedBedlam will not give any of your personal information to any third party without your express approval. RedBedlam does not guarantee the security of any of your private transmissions against unauthorised or unlawful interception or access by third parties.
3.3 Observation: You acknowledge and agree that RedBedlam, in its sole discretion, may track, record, observe or follow any and all of your interactions within the Service. All transmissions to and from the Service are logged for quality of service reasons and to ensure the Account and or the Service are not being abused. These logs will remain protected and confidential.
4.Use of the Service
4.1 Licence: Subject to the terms of this agreement, RedBedlam grants to you a non-exclusive, limited, fully revocable licence to use the Service and RedBedlam’s software on the sole condition that you are in full compliance with this Terms of Service Agreement. You may not charge any third party for using the software to access and/or use the Service, and you may not copy, modify, adapt, distribute, sub-licence, sell, barter, lend, lease, reverse engineer, decompile the software or any part of the Service or any of the written materials associated with the Service except as expressly permitted by this Terms of Service Agreement or by law.
4.2 Internet Service: You acknowledge that RedBedlam is not a traditional game provider; instead RedBedlam acts as a venue and service provider that may allow people to interact virtually regarding almost any topic, at any time, from anywhere, in a variety of formats. In addition, the Service may allow some users to alter the gaming environment on a real-time basis. RedBedlam is not involved in interactions between users within the Service. As a result, RedBedlam has very limited control, if any, over the quality, safety, morality, legality, truthfulness or accuracy of various aspects of the Service. As a condition of access to the Service, you release RedBedlam from claims, demands and damages (actual and consequential) of every kind and nature connected with any dispute you have or claim to have with one or more player/participants. You further understand and agree that: (i) RedBedlam will have the right but not the obligation to resolve disputes between player/participants relating to the Service; (ii) to the extent RedBedlam elects to resolve such disputes, it will do so in good faith based solely on the general rules and standards of the service and will not make judgments regarding legal issues or claims; (iii) RedBedlam’s resolution of such disputes will be final with respect to the virtual world of the Service but will have no bearing on any real-world legal disputes in which player/participants may become involved; and (iv) you hereby release RedBedlam arising out of or in any way connected with RedBedlam's resolution of disputes relating to the Service.
4.3 All Data Is Temporary: When using the Service, you may accumulate objects, experience points, equipment, or other value or status indicators and contribute to the environment. This data, along with any corresponding data stored on RedBedlam’s servers, may be reset and nullified at any time and without warning. Any monetary value attached to said data cannot be redeemed in any way from RedBedlam for whatsoever reason to whomsoever requests or demands it.
5.Charges & Fund Transfers
5.1 Payment: You must use a credit card or other payment method approved by RedBedlam to pay for the Service including any virtual items, currency or objects within the Service. When you provide credit card information or other payment method information to RedBedlam, you represent and warrant that you are the authorised user of the credit card that is used to pay the charges.
5.2 You are fully aware that should you lose virtual items, currency or objects within the Service, paid for by you or earned through the Service itself, RedBedlam is in no way responsible for the loss. You are responsible for any such loss. You agree that your use of the Service is at your sole discretion and risk.
5.3 As the Account holder, you are responsible for all charges incurred, including applicable taxes, and all purchases made by you or anyone you give permission to use the Account(s). Monies held within your online Account will not attract any interest.
5.4 Payment Terms: All charges for the Service are payable in advance. RedBedlam is not responsible for any charges or expenses you incur resulting from charges billed by RedBedlam in accordance with this Terms of Service agreement (e.g. overdrawn accounts, exceeding credit card limit, chargeback, and/or any related financial deficits incurred by the player/participant). By providing a credit card number, you authorise RedBedlam to charge said credit card for all charges due to RedBedlam that have been requested by you as the card holder. RedBedlam reserves the right to limit the number of accounts that may be charged to a credit card.
5.5 All and any completed transactions are non-refundable. Each and any purchase, from any country of origin, is valid for twelve months from the date of purchase. Each and any purchase can only be completed once payment has been made in full. Such purchases cannot be redeemed against any other offer or promotion RedBedlam may be initiating, and is therefore, non-transferable, for sale, re-sale, or redeemable for cash. 5.6 'Charge-back': Should you actively seek refund(s) of real currency to your credit card via charge-back, monies will only be forthcoming should your request be made within the legal and statutory guidelines laid out within your country in which said credit card is registered. While the time limit for charge-back varies in accordance with national legislation, RedBedlam will honour all and any charge-back refunds to credit card holders’ accounts. You should note, however, that RedBedlam reserves the right to suspend and/or terminate all and any Account(s) that have been created and/or associated with all and any credit card(s) holder(s) that seek refunds via the charge-back facility.
5.7 Credit Checks: RedBedlam reserves the right to run credit checks on any playing participant, based upon the information provided to the company on account registration.
5.8 Fund Transfers: RedBedlam acknowledges the responsibility to maintain records of all transactions in accordance with the laws of England and Wales. Account deficits in any situation are the responsibility of the Account holder. RedBedlam accepts no responsibility for funds misplaced or misused in any incidence, regardless of reason.
6.Online Conduct & Content
6.1 The virtual game world of Roma Victor is a fictitious representation of history and so any content associated with historical or perceived historical actions does not necessarily constitute the views and opinions of RedBedlam, its employees, contractors, associates and/or affiliates.
6.2 Your Conduct: In addition to abiding at all times by this Terms of Service Agreement and the Community Standards, you agree that you shall not: (i) take any action or upload, post, e-mail or otherwise transmit content that infringes or violates any third party rights; (ii) impersonate any person or entity, including, but not limited to, a RedBedlam employee, or falsely state or otherwise misrepresent your affiliation with a person or entity; (iii) take any action or upload, post, e-mail or otherwise transmit content that violates any law, regulation or statutory right; (iv) take any action or upload, post, e-mail or otherwise transmit content as determined by RedBedlam at its sole discretion that is harmful, threatening, abusive, harassing, defamatory, libellous, vulgar, obscene, invasive of another's privacy, hateful, racially, ethnically or otherwise objectionable; (v) take any actions or upload, post, e-mail or otherwise transmit content that contains any viruses (i.e. any program that may replicate itself or part(s) of itself to spread by computer interaction), Trojan horses (i.e. any program installed under any false pretences), worms (i.e. uninhibited and unprovoked virus/viruses), time bombs (i.e. any program that is a delayed malevolent attack), or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information; (vi) interfere with or disrupt the Service or servers or networks connected to the service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service; (vii) attempt to gain access to any other user's account or password; or (viii) "stalk" or otherwise harass another user. You agree that RedBedlam may take whatever steps it deems necessary to abridge, or prevent behaviour of any sort on the Service in its sole discretion, without notice to you.
6.3 Use as Provided: You agree to use the Service only as offered by RedBedlam at its website and/or associated and/or partner websites and not through any other means. You further agree not to create or provide any other means through which the Service may be accessed or used, as through server emulators. You acknowledge that you do not have the right to create, publish, and/or distribute derivative works from or use any software programs, utilities, applications, emulators or tools derived from or created for the service, except that you may use the RedBedlam software to the extent expressly permitted by this Terms of Service Agreement.
6.4 Proprietary Rights: The Service and all content available through the Service are owned by RedBedlam, and are protected by copyrights, trade marks, and other intellectual property rights. Objects, places or avatars within the Service will often have names similar or identical to objects, places or people that would have/may have existed or which do/may exist in real life. However, all objects, places or avatars are part of the Service and RedBedlam retains all rights, title, and interest in all parts of the Service. Roma Victor™ is a trade mark of RedBedlam.
6.5 As part of your use of the Service, you may acquire, create, design or modify objects, but you agree that you will not gain any ownership interest of such objects. RedBedlam will retain any and all applicable copyright and/or other intellectual property rights with respect to any content you create or acquire whilst using the Service. To the extent that you do acquire any such rights, you hereby assign to RedBedlam all of your rights, title and interest in any such objects, places and avatars. Any content that you upload or download while using the Service must be authorised; this means you must have the legal right to upload or download the content. By submitting content to any area of the Service, you grant the irrevocable right for RedBedlam to use and reproduce said content for and from RedBedlam’s servers without liability to any party.
6.6 You must not copy, transmit, modify, distribute, show in public or in private or create any derivative works from any of the content on or connected with the Service, unless you have the legal right or express and confirmable permission of RedBedlam to do so. Making unauthorised copies of any content can lead to the termination of the Account and may subject you to further legal action by RedBedlam.
6.7 Age Restriction: RedBedlam cannot absolutely control whether minors gain access to the service, and makes no representation that users are not minors. RedBedlam cannot ensure that other users will not provide content or access to content that parents or guardians may find inappropriate or that any user may find objectionable. You are prohibited from conducting any activity that is not in compliance with the Community Standards.
6.8 Trading: Trades are any items or sanctioned currency within the Service that are intentionally given, by mutual consent, by one player/participant to another player/participant within the Service. RedBedlam does not take responsibility for trade between player/participants. However, when fraudulent behaviour occurs, RedBedlam reserves the right to take appropriate measures, including suspension of or termination of a participant’s account. RedBedlam also reserves the right to vigorously pursue all and any player/participants through whichever legal recourse open to it.
7.Warranties and Liability
7.1 RedBedlam warrants that it will use reasonable care and skill in providing the Service and that the software provided as part of the Service will perform substantially in accordance with its description on the website (provided that Service and the software are used in accordance with this Terms of Service Agreement and are used on a computer in conjunction with an operating system which exceed the minimum specifications stipulated by RedBedlam).
7.2 RedBedlam will use its reasonable endeavours to correct significant errors in the software within a reasonable time. This represents your sole remedy for any breach of RedBedlam’s warranties.
7.3 The express terms of this Terms of Service Agreement are in lieu of all warranties, conditions, undertakings, terms and obligations implied by statute, common law, trade usage, course of dealing or otherwise all of which are hereby excluded to the fullest extent permitted by law.
7.4 RedBedlam does not warrant that the Service (or the software provided with the Service) will meet your requirements or that the use of the Service (or the operation of the software) will be uninterrupted or error-free or that defects in the Service (including the software) will be corrected in any particular timescale. Your use of the Service (including the software) is at your own risk and in no event will RedBedlam be liable to you for any loss or damage of any kind (except personal injury or death resulting from RedBedlam's negligence) including lost profits or other consequential loss arising from your use of or inability to use the Service (including the software) or from errors or deficiencies in it whether caused by negligence or otherwise except as expressly provided herein. In no event shall RedBedlam's liability exceed £5,000 (or such amount that you have paid for the Service, whichever is the greater).
7.5 Indemnification. Upon request by RedBedlam, you agree to defend, indemnify and hold harmless RedBedlam and its affiliates, subsidiaries, employees, contractors, officers, directors, vendors, and content providers from all liabilities, claims and expenses, including legal fees, that arise from a breach of this Terms of Service Agreement for which you are responsible or in connection with your transmission of any content on the Service. RedBedlam reserves the right, at its own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you. This clause shall survive termination of this Terms of Service Agreement.
7.6 This Terms of Service Agreement does not affect your statutory rights (if appropriate) as a consumer.
8.Violation
If you violate any part of this Terms of Service Agreement, your account may be suspended or terminated. Any action taken against the Account due to a violation is the decision of RedBedlam and is final.
9.General Provisions
The rights and obligations of the parties under this Terms of Service Agreement shall be governed by and construed under the laws of England and Wales. You and RedBedlam irrevocably submit for all purposes in connection with this Agreement to the exclusive jurisdiction of the courts of England and Wales. You may not assign or transfer this Terms of Service Agreement or your rights hereunder, and any attempt to do so is void. This Terms of Service Agreement sets forth the entire understanding and agreement between you and RedBedlam with respect to the subject matter of this Terms of Service Agreement. Notwithstanding anything else in this Terms of Service Agreement, no default, delay or failure to perform on the part of RedBedlam shall be considered a breach of this Terms of Service Agreement if such default, delay or failure to perform is shown to be due to causes beyond the reasonable control of RedBedlam. Unless expressly provided in this Terms of Service Agreement, no term of this Agreement is enforceable by any person who is not a party to it.
